1. Introduction

Welcome to Medical German app (the “App”). These Terms and Conditions (“Terms”) govern your access to and use of our Service, including (i) the Medical German mobile application, (ii) the medicalgerman.app website and any sub‑domains (“Site”), and (iii) any related content, features, and offerings (collectively, the “Service”). By downloading, installing, accessing, or using any part of the Service, you (“User,” “you,” or “your”) agree to be bound by these Terms and our Privacy Policy (together, the “Agreement”).

If you do not agree, do not access or use the Service.

2. Eligibility

You must be at least 16 years old—or the age of digital consent in your jurisdiction, whichever is higher—to create an account and use the Service. By accepting these Terms, you represent that you meet this requirement and that you have the legal capacity to enter into the Agreement.

3. Educational Purpose; No Medical Advice

The Service provides educational content designed to improve German language skills in professional medical contexts. It does not provide medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional with any medical questions. Your reliance on any information provided by the Service is solely at your own risk.

4. User Accounts

4.1 Registration. To access certain features you must create an account using an email address, social‑sign‑in, single‑sign‑on, or equivalent credentials.
4.2 Accuracy. You agree to provide accurate, current, and complete information and to keep it updated.
4.3 Security. You are responsible for safeguarding your login credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use.

5. Subscriptions, Pricing & Payments

We offer both free and paid (premium) tiers. Premium features are available through automatically renewing subscriptions (“Subscription”) that can be purchased in‑app or via our Site.

5.1 Free vs Premium
Core learning materials are free of charge. Premium features, their pricing, and any introductory promotions are disclosed before purchase.

5.2 In‑App Purchases (Apple App Store / Google Play)
If you buy a Subscription through an app‑store provider (“App‑Store Provider”), your payment is processed by the App‑Store Provider and governed by its terms. All financial terms (price, taxes, refunds, renewals) are set out in the App‑Store Provider’s interface.

5.3 Web Purchases via Merchant of Record
We also sell Subscriptions on the Site, including “web‑to‑app” funnels that unlock premium features inside the App.

5.3.1 Merchant of Record. For web purchases, the transaction is handled by an authorized merchant‑of‑record (“MoR”). MoR is the seller‑of‑record and will appear on your card or bank statement (e.g., “PADDLE.COM*...”).

5.3.2 Payment Processing. MoR collects and processes your payment, applies any applicable sales tax/VAT/GST, issues invoices, and provides customer billing support. Your use of the MoR checkout is subject to their Terms and Privacy Policy, which are presented at checkout.

5.3.3 Delivery. After a successful web purchase, the premium entitlement is applied automatically to your Medical German account (or via redemption code) so you can enjoy premium content in the App.

5.4 Billing & Auto‑Renewal
Unless otherwise stated, Subscriptions auto‑renew for the same term (e.g., monthly or yearly) at the then‑current price until canceled. Your payment method will be charged up to 24 hours before the start of each renewal period.

5.5 Taxes & Currency
Prices are shown in your selected currency and, where required by law, are inclusive of VAT/GST or other indirect taxes. App-Store Provider/MoR calculates, collects, and remits such taxes on our behalf.

5.6 Cancellation & Refunds

5.6.1 General Refund Criteria
  • Free‑Trial Subscribers. If you began with a free trial and were charged at the end of the trial, you may obtain a full refund provided that you have not completed any exercises during either the free‑trial period or the paid period that followed.
  • Up‑Front Purchasers. If you purchased a Subscription at full price without first viewing content, you may obtain a full refund provided that you have completed exercises on no more than three (3) distinct calendar days after the purchase date.
  • Refund Scope. If your Subscription has renewed more than once, only the most recent charge (i.e., the latest renewal fee) is eligible for refund; payments for earlier completed billing periods are non‑refundable.
For purposes of this policy, a "day" means a single calendar date in your local time zone, and "using the app" means completing at least one learning exercise inside the App., a “day” means a single calendar date in your local time zone, and “using the app” means completing at least one learning exercise inside the App.

5.6.2 How to Request a Refund
  • Google Play Purchases. Email support@medicalgerman.app with your Google Play order number (e.g., GPA.1234‑5678‑...). If your request meets the criteria above we can issue the refund directly via Google Play.
  • Apple App Store Purchases. Submit your request at https://reportaproblem.apple.com. We will promptly indicate our approval or disapproval to Apple based on the criteria above, but Apple makes the final decision and issues any refund.
  • Web (Merchant of Record) Purchases. Use the MoR's self‑service link in your receipt or email their support with your order reference. We will confirm our approval to MoR if the request meets the criteria above; Paddle will then process any approved refund to your original payment method.
Refunds are credited in the original payment currency and method. Processing times may vary depending on your bank or card issuer.

5.6.3 Statutory Rights
Nothing in this Section limits any mandatory statutory refund or withdrawal rights that apply in your jurisdiction (e.g., the 14‑day right of withdrawal for EU/EEA consumers).

6. License Grant & Restrictions
We grant you a limited, non‑exclusive, non‑transferable, revocable license to download, install, and use the Service for personal, non‑commercial educational purposes, subject to the Agreement. You agree not to:
  • Copy, modify, adapt, translate, reverse‑engineer, decompile, or create derivative works of the Service;
  • Circumvent, disable, or interfere with security‑related features;
  • Use the Service for any unlawful, infringing, or harmful purpose.

7. Intellectual Property
All content and functionality—including text, graphics, audio, video, and software code—are owned by us or our licensors and are protected by copyright, trademark, and other intellectual‑property laws. No rights are granted to you except the limited license set out in Section 6.

8. User Content

8.1 License to Us. You grant us a worldwide, royalty‑free, sublicensable license to host, display, reproduce, and otherwise use your User Content solely to operate and improve the Service.

8.2 Responsibility. You warrant that you own or have the necessary rights to submit the User Content and that it does not violate any law or third‑party right.

9. Third‑Party Links & Services
The Service may contain links to third‑party websites or services. We do not endorse and are not responsible or liable for third‑party content, products, or services.

10. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non‑infringement. We do not warrant that the Service will be uninterrupted, secure, or error‑free.

11. Limitation of Liability
To the maximum extent permitted by law, we (and our officers, directors, employees, and agents) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or in connection with your use of or inability to use the Service. Our total aggregate liability under the Agreement shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim or (b) €50.

12. Indemnification
You agree to defend, indemnify, and hold harmless us and our affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your (i) use of the Service, (ii) User Content, or (iii) violation of the Agreement or any applicable law.

13. Termination
We may suspend or terminate your access to the Service, in whole or in part, at any time and for any reason, with or without notice. Upon termination, Sections 6–16 will survive.

14. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Republic of Cyprus, without regard to conflict‑of‑law principles. You agree to first attempt to resolve any dispute informally by contacting us. If unresolved, disputes shall be submitted to the competent courts of Cyprus, unless mandatory consumer law gives you the right to bring the dispute before the courts of your habitual residence.

15. Changes to the Terms
We may modify these Terms at any time. We will post updated Terms on the Site or in the App and update the “Last Updated” date below. Continued use after changes take effect constitutes acceptance of the revised Terms.
